LGBT & Domestic Partner Planning

Estate & Long Term Care Planning for Same Sex Couples and Domestic Partners

Nearly 11 million people in the U. S. are cohabitating couples. 1.4 million live in same-sex (LGBT) households, defined by the U. S. Census Bureau. Many states, including Florida, do not recognize same sex marriage or civil unions.

Many same sex households and unmarried heterosexual couples do not have children who, traditionally, are the providers of long term care as people age. Did you ever ask yourself, “Who is going to take care of me?” “Will my partner be allowed to make legal and medical decisions for me, if I am incapacitated?”

What if you die without a Will? In Florida, a domestic or same sex partner will not automatically inherit the couple’s assets, and those assets may be distributed to the person’s family according to current law.

When you meet with us, we will co-create a legal plan tailored to meet your goals so that you and your partner may have the future you envision.

Hospital Visitation Rights

We hope the incident that occurred at Jackson Memorial in Miami, FL when a same-sex partner and the children were denied access to their dying loved one, never happens again. This is achieved through awareness and education. We can help protect your visitation rights and legal rights.

Following the case of Langbehn v. Jackson Memorial Hospital, President Barack Obama issued a memorandum requiring hospitals and facilities that receive government funds to allow visitation to partners of patients or residents. The Center for Medicare & Medicaid Services (CMS) created federal regulations on patient visitation rights. Click here to view the White House Memorandum.
